Olympia police arrested the 30-year-old on suspicion of second-degree felony assault after the incident, which occurred about 1:45 a.m. Tuesday in the 300 block of Fourth Avenue East. Thurston County Deputy Prosecuting Attorney James Powers said the man might still face charges of unlawful discharge of a firearm, unlawful display of a firearm or reckless endangerment, but those are misdemeanors and wouldn’t be filed by his office.
The man was to be released Wednesday afternoon from the Thurston County Jail, court officials said.
It will be up to the Olympia City Prosecutor’s Office to decide whether to file misdemeanor charges, Powers said. Olympia’s city prosecutor could not be reached for comment.
