Tumwater police officers responded to a disturbance in the 1300 block of Sunrise Vista Lane after 6 p.m. Wednesday involving a husband and wife, according to Tumwater Det. Jen Kolb.
Officers identified the husband as 59-year-old Tumwater Superintendent Michael Kirby.
“There were allegations (by the wife) that an assault took place,” Kolb said. “Based on their investigation, officers found probable cause to arrest Mr. Kirby.”
Kirby was booked into Nisqually Jail, Kolb said.
A fourth-degree assault domestic violence charge is “basically any unwanted touching,” Kolb said.
The school district was told of the charge Wednesday and has yet to take action, district spokeswoman Kim Howard said Saturday.
“The School Board is aware of it, it’s in the legal system, but there hasn’t been any action taken,” Howard said.
Kirby was not put on any sort of leave, Howard said.
“Our focus at this point is just on continuing to serve our students,” Howard said.
Kirby has run daily operations in Tumwater’s school system since 2010.
