A 20-year-old Elma man has been charged with assault for allegedly hitting an older man with a skateboard, taking his cane and striking him with it, according to The Daily World of Aberdeen.
Patrick J. Dockery has pleaded not guilty to third-degree assault for allegedly beating the man May 18 near Elma High School.
Dockery and a juvenile were skateboarding in the street when a 64-year-old man confronted them about being in the way, court papers state. High school students watched from their nearby classrooms.
“This young man threatened to assault him and the young man spat” on him, the alleged victim told police in court records. “The defendant came up during this argument and struck (him) with his skateboard. (The older man) was knocked to the ground, and the defendant picked up (the man’s) cane and struck him with it four or five times.”
Dockery admitted hitting the man but said he acted in self-defense when the man became aggressive, court papers state.
“I was breaking a fight up,” he wrote in court forms.
