OLYMPIA - A former casino bartender convicted of raping a 24-year-old Lacey woman was sentenced Wednesday to nearly eight years in prison.
In July, a Thurston County jury convicted Marcos Roberto Lozano, 29, of one count of second-degree rape. The jury acquitted Lozano of another count of second-degree rape. Lozano had been charged with two counts based on the accusations of two women.
The woman Lozano was convicted of raping said the attack occurred in the early morning Feb. 8, 2009, while she was drunk and passed out on a couch at his apartment in the 7900 block of Fourth Court, just east of Lacey.
The woman testified that she had been drinking with friends in Spanaway the night of Feb. 7 and had arranged for a friend to drive her home. The friend earlier had arranged a meeting with Lozano on the social networking site MySpace. The victim agreed to accompany the friend to Lozano’s apartment, and she testified that she passed out soon after she arrived there.
The friend of the victim testified that she had consensual sex with Lozano. She also testified that when she woke up during the night, she interrupted Lozano having sex with her friend as she was passed out on the couch.
Lozano took the witness stand and said he and the victim had engaged in consensual sex.
Also at trial, a 21-year-old woman testified that she had met Lozano on MySpace and arranged a meeting with him at a Lacey bar the night of Feb. 16. She said Lozano raped her in his apartment that night. Lozano also said the sex with that woman was consensual.
Lozano was arrested based on the 21-year-old’s accusation. The other woman has said she came forward to police after the 21-year-old woman’s allegation was publicized in media reports.
Lozano must register as a sex offender after he completes his prison sentence.
