Joseph Duggar Appears in Court 3 Months After Child Molestation Arrest
Joseph Duggar attended a court hearing regarding his child molestation case in Florida.
Duggar, 31, appeared via Zoom in a Bay County, Florida, courtroom on Tuesday, June 16. He wore a tan suit with a navy tie and appeared stone-faced throughout the hearing, smiling at the end as he thanked the judge for his time.
During the hearing, Duggar's attorney asked to clear up the language in a previous motion regarding unsupervised contact with minors, claiming that the motion has caused issues with the 19 Kids and Counting alum's ability to have contact with his own children, who are not the alleged victims in his Florida case. (Joseph and wife Kendra Duggar share four kids. He was unable to communicate with his children following his arrest.)
The prosecution argued that the scenario is complicated due to the fact that Joseph's children are the alleged victims in the case of his and Kendra's March arrests for child endangerment. According to assistant state attorney Joao Paulo Ferreira, Children and Family Services in Arkansas are willing to supervise contact with his children in that case. He argued that Joseph can comply with the requests of the Arkansas DCF to have contact with his kids.
Joseph's attorney, Albert Sauline, argued that it would be "a little unusual" for a criminal case in Florida to prohibit contact with his kids when the children are not the alleged victims in the case.
Judge Brantley S. Clark ultimately ruled that Joseph can have supervised contact with his children in regard to the Florida case.
Joseph's lawyer also requested to amend a motion stating that he cannot be within 500 feet of the alleged victim's former home in Florida, arguing that the victim and her family have moved away from that property and that the order is interfering with Joseph's ability to complete his work as a landlord in the area.
The judge denied the motion to amend the order, stating that an employee of Joseph's can visit the properties for him.
Joseph's next appearance in court is scheduled for July 14.
One day before the hearing, Joseph filed a motion to amend his no contact order, and was seeking permission to see his biological kids, according to a court docket viewed by Us Weekly.
Us previously confirmed that Joseph was arrested by the Tontitown Police Department in Arkansas on March 18. He was charged with lewd and lascivious behavior involving molestation of a victim less than 12 years old and lewd and lascivious behavior conducted by a person 18 years or older.
The accusations stemmed from a police interview with a 14-year-old alleged victim who reported multiple incidents involving Joseph during a 2020 family vacation to Panama City Beach when she was 9. The girl claimed that after Joseph repeatedly asked her to sit on his lap, he asked her to sit beside him on a couch, where he "grazed her genitals" while they were covered with a blanket.
The victim alleged to the authorities that Joseph "eventually apologized for his actions and the incidents stopped after the apology."
According to investigators, the alleged victim's father confronted Joseph on March 17, which allegedly led to Joseph admitting his actions to the alleged victim's father and Tontitown detectives.
Two days after his arrest, Joseph made a virtual appearance in court. Though he did not enter a plea at the time, he waived his right to an extradition hearing, meaning he agreed to be transferred from Arkansas to Florida to face the charges against him.
According to an affidavit for his arrest obtained by Us on March 26, Joseph's alleged victim claimed "several instances of sexual abuse" occurred with the former reality star when she was 9 years old. The accuser recalled feeling "uncomfortable" and "confused" by the alleged incidents.
The affidavit also stated that Joseph allegedly "admitted his actions, stating he touched the victim over her clothing," and "admitted his intentions" with the minor "were not pure." Duggar's alleged confessions happened during a phone call with the alleged victim's father, which police documented.
As Joseph awaited extradition to Florida on child molestation charges, his wife, Kendra Duggar, was arrested on March 20. Both she and Joseph were charged with four counts of endangering the welfare of a minor, second degree and four counts of second degree false imprisonment. Kendra, 27, was released later that day after paying her $1,470 bond.
"Kendra's arrest has nothing to do with Joseph's - although one precipitated another," a source with knowledge of the case exclusively told Us on March 21. "After his charge, they automatically do a home study if minors live there. They came to her house."
"Apparently, they had two rooms where the lock of the doorknob was on the outside instead of inside," the insider continued. "They arrested her and took her kids for that, saying it's evidence that she wrongly detains her kids."
Joseph and Kendra have been married since September 2017.
