Timeline: Kelso man says firearms unlawfully seized after temporary protection order

A Kelso man is suing Cowlitz County for what he says was the unlawful seizure of his weapons following a temporary protection order filed by his wife's cousin.

A temporary protection order doesn't explicitly say he must surrender his guns, according to the lawsuit filed by Zane Hogue, who is married to the granddaughter of the diner's owners.

March 18: Zachary McCarthy, 27, of Longview, says Zane Hogue, his cousin-in-law, threatens to beat him up on Commerce Avenue.

March 19: McCarthy files for a protection order against Hogue.

March 23: Cowlitz County District Court approves a temporary protection order for McCarthy against Hogue, 31, of Kelso.

Around March 25: The Cowlitz County Sheriff's Office seizes Hogue's firearms from his Kelso home.

March 25: Hogue's wife, Skai, talks to a sheriff's office deputy who says the guns shouldn't have been seized, according to the lawsuit.

March 27: Zane Hogue receives a written notice to transfer his collected firearms within 60 days, or they will be forfeited.

March 27: A protection order requested against McCarthy by Skai Hogue is denied in Cowlitz County Superior Court because the petition didn't include a specific incident warranting protection, according to court records.

April 1: Zane Hogue's attorney delivers a written notice to the sheriff's office explaining the unlawful seizure of weapons. Later that day, Cowlitz County Undersheriff Troy Brightbill tells the attorney the weapons will be returned.

April 20: A longer protection order against Zane Hogue for McCarthy is denied in Cowlitz County District Court.

July 3: Zane Hogue files a federal lawsuit against the county for the unlawful seizure of his weapons.
